Terms of Service

Welcome to Orca. These terms govern your use of the Orca Chrome extension and pingorca.com ("the Service"). By using Orca, you agree to them. If you don't agree, please don't use Orca.

1. The Service

Orca is a browser extension that lets you invoke an AI assistant via @orca in social-platform comment sections, plus a sidepanel chat for longer interactions. We route your requests to third-party AI providers (currently Google Gemini) and return their answers to you.

2. Eligibility

You must be at least 13 years old to use Orca (16 in the EEA / UK). By creating an account, you confirm you meet that age requirement and that you're providing accurate registration information.

3. Plans & Pricing

Orca offers two plans:

Free — $0 forever. 5 text messages per day, 5 image generations (lifetime), with a "Made with Orca" watermark on generated images. Access to standard models only.
Pro — $9.99 USD per month or $89.99 USD per year (save ~25%). 2,000 text messages per month, 50 image generations per month, 300 Orca Max thinking-model messages per month, no watermark, cloud sync of chat history, and priority access to new features. Annual subscriptions include a 7-day free trial; monthly subscriptions are billed immediately.

Quota counters reset at the start of each billing period (Pro) or at midnight UTC (Free daily). Lifetime quotas (Free image generation) do not reset; you may earn additional credits by inviting friends.

4. Subscriptions & Auto-Renewal

Pro subscriptions automatically renew at the end of each billing period using the payment method on file, until you cancel.

Trial (annual only) — if you choose the annual plan, your 7-day free trial begins the moment you complete Checkout. We'll email you a reminder 3 days before your card is charged. If you cancel during the trial, you won't be charged. Monthly subscriptions do not include a trial.
Cancellation — you can cancel anytime via the "Manage subscription" link in the Orca extension or the Stripe customer portal. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
Failed payments — if your card is declined, we'll retry over the following 15 days and email you each time. If all retries fail, your subscription is canceled and your account reverts to Free.

5. Refunds

We offer a 14-day refund on your first paid period if you're unsatisfied. After 14 days, refunds are at our discretion and generally not provided for partial periods. Trial periods are not chargeable, so refunds don't apply.

To request a refund, email support@pingorca.com within 14 days of your first charge.

6. Acceptable Use

You agree not to:

Use Orca to generate or distribute illegal, harassing, or harmful content.
Impersonate others or pretend Orca-generated content was created by a human in contexts where that misrepresentation could cause harm.
Use the Service to reverse-engineer, scrape, or extract content from the underlying AI providers in violation of their terms.
Bypass quota limits via multiple accounts, automation, or other circumvention.
Resell, white-label, or sublicense access to the Service without our written consent.

We may suspend or terminate your account for material violations, with notice where reasonable.

7. Your Content

You retain all rights to content you submit to Orca. By using the Service, you grant us a limited license to process your content solely as needed to operate Orca (route to AI providers, return responses, maintain quality). We do not use your content to train AI models. See our Privacy Policy for details on how we handle your data.

8. Orca's Intellectual Property

The Orca name, logo, extension code, and website are owned by us. You're granted a personal, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, either express or implied. AI-generated content may be inaccurate, incomplete, or unsuitable for your purpose — please review responses before relying on them for any consequential decision. We don't guarantee uninterrupted availability or specific response times.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you've paid us in the 12 months preceding the claim (or $50, whichever is greater). We are not liable for indirect, incidental, consequential, or punitive damages.

11. Termination

You may stop using Orca and delete your account at any time. We may terminate your account for violations of these terms or if the Service is discontinued (with reasonable advance notice). On termination, your right to use the Service ends; data is removed per our Privacy Policy.

12. Changes to These Terms

We may update these terms occasionally. Material changes will be communicated via email or an in-product notice with at least 14 days' notice. Continued use after the effective date means you accept the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where local consumer-protection law requires otherwise.
